Twitter への写真画像アップロードサービスの Twitpic が2014年9月25日に終了。データエクスポート機能を数日中に用意してくれるとのこと (ほんとに用意してくれるんだろうか・・・)。

Twitter上で写真やムービーを共有できるサービス「Twitpic(ツイピク)」が、2014年9月25日にサイトを閉鎖しサービスを終了するという発表を行いました。今回の突然なTwitpic閉鎖にはTwitterとの衝突が背景にあるようです。

Twitpicの発表によると、今回の閉鎖はTwitterとの軋轢のための苦渋の決断であるとのこと。ブログでは、「数週間前にTwitterサイドからTwitpicが保有する商標を放棄するよう要求され、『従わない場合にはTwitterのAPIへのアクセスを遮断されるリスクを負う』という通告を受けた」と告白しています。

Twitpicは2008年からサービスを開始し、2009年には米国特許商標庁に商標を登録してサービスを続けていたため、今回のTwitterからの通告は寝耳に水であったとのこと。

Twitpicは、「これまでTwitpicという商標を自分たちのものであると信じてきた私たちは、残念ながらTwitterのような大企業を相手にして商標を守り抜くため法的に対抗するリソースを持っていません。そのためTwitpicを閉鎖することを決定しました」と発表しています。

Twitpicは、写真とビデオのエクスポート機能を開発して、過去、現在のユーザーが閉鎖前に自分のコンテンツを引き取れるようにする予定だが、まだ準備は整っていない。

これに対して、米Twitterのスポークスパーソンは「我々は、Twitpicの閉鎖を悲しく思う。我々はTwitpicが何年もしてきたように、開発者がTwitterサービス上で開発することを奨励している。そして、我々はTwitpicの名称で彼らが運用できることをはっきりさせている。当然のことながら、我々もまたブランドを保護しなければならず、それにはブランドと結び付いている商標が含まれている」とコメントした。

このTwitterのコメントは解釈が難しい。Twitpicが引き続きTwitpicとして運用可能だと説明しているからだ。

これについて知的財産権を扱う弁護士のJ Nicholas Gross氏は1つの解釈として、Twitterは、Twitpicと名乗ること自体に問題はないが、商標登録は認めず、他のサービスもまたTwitpicと名乗ることも可能にしておきたいのではないかと指摘している。いずれにせよ、これについて米Twitterは説明していないため、真偽を確認することはできない。

This is an unexpected and hard announcement for us to make and we want to lay out what led us to this decision.

A few weeks ago Twitter contacted our legal demanding that we abandon our trademark application or risk losing access to their API. This came as a shock to us since Twitpic has been around since early 2008, and our trademark application has been in the USPTO since 2009.

Here is some backstory on the history of our trademark:

We originally filed for our trademark in 2009 and our first use in commerce dates back to February 2008 when we launched. We encountered several hurdles and difficulties in getting our trademark approved even though our first use in commerce predated other applications, but we worked through each challenge and in fact had just recently finished the last one. During the “published for opposition” phase of the trademark is when Twitter reached out to our counsel and implied we could be denied access to their API if we did not give up our mark.

Unfortunately we do not have the resources to fend off a large company like Twitter to maintain our mark which we believe whole heartedly is rightfully ours. Therefore, we have decided to shut down Twitpic.

On a personal note I (@noaheverett) want to thank you for letting us be a part of your life and helping you share your experiences over the past 6 years, it’s truly been an honor. I have learned so much through running Twitpic over the years. Through the many mistakes I’ve made and lessons learned, to the bad days and the great days. Thank you again everyone…I will miss and cherish the days of Twitpic we had together.

エクスポートする方法 (追記 2014-09-14)

いままで投稿した写真画像をバックアップできるようになっていた。

Twitpic にログインして、右上のメニューから settings をクリック。

settings ページの一番下に

「Requrst Your Data」というボタンがあるので、これをクリック。

Twitpic 側がダウンロードできるように準備してくれるので、しばらく待ってから またこの settings のページの一番下部をチェックする。

ダウンロードできるようになっても特に通知とかもらえないので、自分でたまにチェックする必要がある。自分の場合は画像ファイル数4000個ぐらいで2日後にはできてた。画像ファイル30個ぐらいでは、1時間もかかっていなかった。実際に、どれだけ時間がかかるものなのかは不明。

いつのまにか「Download Now」というリンクができているので、これをクリックすると Twitpic に投稿した写真画像をまとめた zip ファイルをダウンロードすることができる。

画像ファイル名は http://twitpic.com/1fg0mk というURLの場合、 1fg0mk.jpg というようなファイル名で収められている。

また、zip ファイルの中には、写真画像ファイルだけじゃなくて、ファイル名とツイート内容 (というかTwitpic側に投稿したテキスト) が書いてある tweets.txt というファイルも入っている。

Twitpic が終了しなくて良くなったそうな (追記 2014-09-19)

9月25日にサービスを終了するとしていたTiwtter向け写真共有サービスTwitpicが、存続できることになったと発表した。ある企業に買収されることになったためとしている。

Twitpicは9月4日にTwitterからの法的要請により9月25日をもってサービスを終了すると発表していたが、どうやら閉鎖は回避されそうだ。買収による同社の救済措置のようだが買収先などは現時点では不明。詳細は後ほど公式ブログなどで公表するとしている。
